Madison, Wisconsin, EUA

When deciding whether to become an Airbnb host, it's important for you to understand the laws in your city. As a platform and marketplace we do not provide legal advice, but we want to provide some useful links that may help you better understand laws and regulations in Madison, WI. This list is not exhaustive, but it should give you a good start in understanding your local laws. If you have questions, contact city agencies directly, or consult a local lawyer or tax professional.

  • General Information. The city provides general information about rules and regulations on its Short-Term Rentals page. This includes basic information regarding who may rent, and how often.

  • License and Permit Requirements. Madison requires all hosts to consult with three separate agencies in order to list their space on home sharing sites like Airbnb. This includes obtaining a sellers permit with the Department of Revenue, a license with the Public Health department, and verifying operating conditions with City of Madison Zoning. More information can be found on the city’s Short-Term Rentals page.

  • Taxes and Fees. As of May 1, 2017, Airbnb collects and remits taxes to the City of Madison on behalf of its users. More information is available about that process here. If you rent on other platforms in addition to Airbnb, you are responsible for collecting and reporting the taxes and fees from any rental arrangement made on those other platforms or through any other means. For more information, visit the City Clerk’s memo on room tax.

  • Zoning Restrictions. Most residential areas in the City of Madison allow short-term rentals. Contact City of Madison Zoning at (608) 266-4551 to ensure that this activity is allowed in your area, and to discuss conditions that may need to be met. For more information, visit the City’s FAQ.

  • Other Rules. It's also important to understand and abide by other contracts or rules that bind you, such as leases, condo board or co-op rules, HOA rules, or rules established by tenant organizations. Please read your lease agreement and check with your landlord if applicable.

We are committed to working with local officials to help them understand how Airbnb benefits our community. Where needed, we will continue to advocate for changes that will allow regular people to rent out their own homes.
